Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Journal App website and services ("Services"). Please read these Terms carefully.
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.
These Terms constitute a legally binding agreement between you and Journal App. You must be at least 13 years old to use our Services.
Account Terms
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your account, and you agree to accept responsibility for all activities that occur under your account.
Account Security
You agree to:
- Create a strong password and keep it confidential
- Maintain the security of your account
- Promptly notify Journal App if you discover or suspect any security breaches related to your account
- Take responsibility for all activities that occur under your account
Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms, create risk or possible legal exposure for Journal App, or for any other reason in our sole discretion.
User Content
Our Services allow you to create, upload, store, share, send, and receive content, including journal entries, comments, images, and other materials ("User Content").
Content Ownership
You retain ownership rights in your User Content. However, by creating or sharing User Content on or through our Services, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display and distribute such User Content to the extent necessary to provide and improve our Services.
Content Responsibility
You are solely responsible for your User Content and its consequences. Journal App has no obligation to preview, verify, flag, modify, filter, or remove any User Content, even if it includes harmful, inaccurate, or objectionable material.
By submitting User Content, you represent and warrant that:
- You have the legal right to create, upload, and share your User Content
- Your User Content does not infringe or violate the rights of any third party
- Your User Content complies with these Terms and all applicable laws
Acceptable Use Policy
You agree not to misuse our Services or assist anyone else in doing so. You agree not to engage in any of the following prohibited activities:
- Using our Services for any illegal purpose or in violation of any laws
- Posting or transmitting viruses, malware, or other harmful code
- Interfering with or disrupting the integrity or performance of our Services
- Attempting to probe, scan, or test the vulnerability of our systems
- Impersonating another person or entity or misrepresenting your affiliation
- Collecting or harvesting user data without consent
- Sending spam or unsolicited communications
- Posting content that is defamatory, obscene, or otherwise objectionable
- Harassing, intimidating, or threatening other users
Journal App reserves the right to remove content and terminate accounts for violations of this policy, at our sole discretion.
Intellectual Property Rights
The Journal App service and all materials therein, including software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, and all intellectual property rights related thereto, are the exclusive property of Journal App and its licensors.
Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such intellectual property rights, and you agree not to:
- Sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any Journal App content
- Use any automated means to access the Services
- Decompile, reverse engineer, or disassemble the Services or any component
- Remove any copyright, trademark or other proprietary rights notices
- Transfer any part of the Services to another person or entity
Termination
We may terminate or suspend access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services, or delete your account through your account settings.
Disclaimer of Warranties
Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Journal App does not warrant that:
- The Services will function uninterrupted, secure or available at any particular time or location
- Any errors or defects will be corrected
- The Services are free of viruses or other harmful components
- The results of using the Services will meet your requirements
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Journal App, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Services
- Any conduct or content of any third party on the Services
- Any content obtained from the Services
- Unauthorized access, use or alteration of your transmissions or content
Whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Amendments to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
